The process continues. And also mentioned time (last one month), therefore, we use present perfect continuous.

Why not to be used in the part of "has not been" in " had not been"? I think it is wrong.

Time sense should not use in case of present continuous tense. So present perfect should be use here so correct from should be have been or has been.
