The powers to legislate with respect to any matter not enumerated in any of the three lists are mentioned as residuary powers. Which of the following is empowered to determine finally as to whether or not a particular matter falls in this category

Lok Sabha decides as to which matter is 'residuary'. Parliament also has some overriding powers in case of legislative conflict between center and state. Rajya Sabha too can empower parliament to legislate on any matter listed as a state subject in the seventh schedule. Constitution clearly gives more weight to centres say in such matters under various provisions. I don't think judiciary has any role here.

The constitution enables the central dominance over state in case there is a residuary subject requiring legislation. The highest court has the final say in settling disputes regarding excercise of power and authority.

Judiciary consists of officers who have a power to serve in any side of India named as IAS, IPS, AIR, IRS officers etc. ,

The Parliament of India has a final say in determining whether the matters falls withing its jurisdiction or not.

Rajya sabha decides by 2/3rd majority whether parliament will legislate on residuary subject or not.
