Lok Sabha decides as to which matter is 'residuary'. Parliament also has some overriding powers in case of legislative conflict between center and state. Rajya Sabha too can empower parliament to legislate on any matter listed as a state subject in the seventh schedule. Constitution clearly gives more weight to centres say in such matters under various provisions. I don't think judiciary has any role here.
