Sometimes questioning of the validity of the law doesn't mean not to follow the earlier established law.
Questioning of anything can also be considered as reviewing of the law in a broader sense, it may help in developing the law more than that was earlier.

The meaning of "procedure established by law" is the judiciary cannot question the validity and morality of the law in the limits of constitution. They must go according to the law, but in the case of USA the judges of federal court or any provincial courts can declare any law as in Valid and outdated and unjust, if they satisfied that as unjust.
