habeas corpus in other words is basically a writ issued by the govt wherein a person who is arrested has to be present in the court for the trail within 24 hours of his arrest.

If imprisonment found illegal the prisoner has right to release forthwith and this writ we can enforce under article 32 in supreme court and in high court under article 226.

Habeas corpus means to have a body. No person can be detained and deny of justifying his side and so to prove that he can ask for counsel or he himself can do so.

You can directly go to Supreme Court and High Court to file Habeas Corpus under Article 32 and 226/227 of Constitution of India respectively.
